SUAY AFFILIATE PROGRAM TERMS AND CONDITIONS
Effective September 28, 2026
Welcome to the Suay Affiliate Program.
These Terms and Conditions apply to every person or entity participating in the Suay Affiliate Program (“Affiliate,” “you,” or “your”). “Suay,” “we,” “us,” and “our” refer to Suay Brands LLC.
By applying to or participating in the Program, you agree to these Terms and Conditions. If you do not agree to them in their entirety, you may not participate in the Program.
1. APPLICATIONS AND APPROVAL
We reserve the right to approve or reject any Affiliate application in our sole discretion. Approval is limited to the applicant and promotional properties disclosed in the application.
Affiliates must provide accurate and complete information about their identity, websites, social-media accounts, advertising methods, and intended promotional activities. Any material change in promotional methods must be disclosed to Suay upon request.
2. AFFILIATE LINKS AND COUPONS
Approved Affiliates receive a unique referral link and may receive an assigned coupon code. Affiliates may promote only links, coupons, discounts, and creative materials authorized by Suay.
Affiliates may not advertise expired, altered, leaked, unauthorized, or customer-specific coupon codes. Affiliates may not claim that a coupon provides a discount different from the discount actually offered.
If a customer interacts with multiple affiliate links, attribution will be determined by the tracking rules shown in the Affiliate Dashboard. A customer’s use of both an affiliate link and coupon does not create multiple commissions.
3. PAID SEARCH AND TRADEMARK POLICY
Affiliates may not use paid search, pay-per-click advertising, sponsored search results, shopping ads, display ads, retargeting ads, or similar paid advertising to promote Suay without Suay’s prior written approval.
Regardless of whether general paid advertising has been approved, Affiliates may not bid on, purchase, target, or otherwise use any Suay Protected Term as a keyword, search term, audience signal, campaign target, ad-group target, or similar advertising input.
“Suay Protected Terms” include, but are not limited to:
- Suay
- Suay Hats
- suay.com
- Apex or Apex Hat
- Nomad or Nomad Hat
- Drift or Drift Hat
- Horizon or Horizon Hat
- Endurance or Endurance Hat
- Any other Suay brand, collection, collaboration, or product name
- Misspellings, variations, plural forms, abbreviations, or confusingly similar versions of these terms
- Any Protected Term combined with words such as coupon, code, discount, deal, sale, promo, review, official, or website
Affiliates conducting any approved paid-search activity must add Suay Protected Terms as negative keywords where the advertising platform permits.
Affiliates may not:
- Direct paid advertisements to Suay through an affiliate link, tracking link, redirect, or intermediary page without prior written approval
- Use Suay trademarks, product names, logos, or confusingly similar terms in advertisement copy, display URLs, domains, subdomains, social-media account names, or advertiser identities
- Present themselves as Suay, an official Suay account, or an authorized Suay advertising representative
- Place advertisements that compete with Suay’s own branded search results
- Use misleading review, comparison, coupon, or deal pages primarily to intercept customers already searching for Suay
- Allow an advertising agency, sub-affiliate, network, or other third party to engage in conduct prohibited by this section on the Affiliate’s behalf
Organic editorial content, genuine product reviews, unpaid social-media content, and other value-adding content are permitted, provided they are accurate, transparent, and do not impersonate Suay.
4. PROHIBITED PROMOTIONAL METHODS
Affiliates may not use cookie stuffing, forced clicks, automatic redirects, adware, spyware, browser extensions, pop-ups, hidden frames, misleading links, trademark impersonation, fraudulent orders, self-referrals, spam, or any other method that creates attribution without a customer’s intentional interaction with legitimate Affiliate content.
Affiliates may not make false, unsupported, or misleading statements about Suay or its products. Affiliates must comply with applicable advertising laws and clearly disclose their affiliate relationship wherever required.
5. COMMISSIONS AND PAYMENTS
Commission rates, cookie duration, payout thresholds, and other program details are displayed on the registration page or Affiliate Dashboard and may vary by program tier.
Commissions are calculated on eligible product revenue and exclude taxes, shipping, fees, refunds, returns, cancellations, chargebacks, fraudulent transactions, and other excluded amounts.
All referrals are subject to review. A tracked order does not become payable until Suay approves the commission. Transactions resulting in refunds, returns, cancellations, chargebacks, fraud, duplicate attribution, self-referrals, or violations of these Terms are not eligible for commission.
Suay may place commissions under review while investigating traffic sources, advertising practices, order validity, or compliance with these Terms.
Commissions reasonably connected to a violation may be denied, reversed, withheld, or deducted from future payments. Suay may request advertising reports, traffic-source records, campaign settings, destination URLs, screenshots, or other documentation needed to verify compliance. Failure to provide reasonably requested documentation may result in denial of affected commissions or removal from the Program.
6. MARKETING MATERIALS AND BRAND ASSETS
Suay may provide approved logos, photographs, banners, product information, or other marketing materials through the Affiliate Dashboard.
Affiliates may use these materials only to promote Suay through permitted channels. Affiliates may not materially alter Suay trademarks, create unauthorized brand assets, imply sponsorship beyond the Affiliate relationship, or use outdated materials after Suay asks that they be removed.
7. NETWORKS AND SUB-AFFILIATES
If network or sub-affiliate features are enabled, Affiliates may invite other participants as permitted by the Affiliate Dashboard.
The primary Affiliate is responsible for ensuring that its employees, contractors, agencies, sub-affiliates, and advertising partners comply with these Terms. Conduct performed on an Affiliate’s behalf will be treated as conduct performed by the Affiliate.
8. TRACKING COOKIES
Suay uses tracking technology to attribute eligible purchases. Cookie duration is displayed on the registration page or Affiliate Dashboard.
Tracking depends on the customer’s browser and privacy settings. Suay is not responsible for unattributed commissions when a customer blocks or deletes cookies, changes devices or browsers, or otherwise prevents tracking.
9. SUSPENSION AND TERMINATION
Suay may suspend or terminate an Affiliate account for violating these Terms, providing inaccurate application information, using prohibited promotional methods, creating reputational or legal risk, or engaging in conduct inconsistent with the purpose of the Program.
When an account is suspended or terminated, Suay may review all unpaid commissions and deny commissions connected to prohibited conduct. Valid commissions earned before termination that are not connected to a violation will remain subject to the normal review, approval, return, and payout process.

10. CHANGES TO THESE TERMS
Suay may update these Terms from time to time. Updated Terms will apply prospectively beginning on the stated effective date.
Existing Affiliates may be notified of material changes through email, the Affiliate Dashboard, or another reasonable method. Continued participation after the effective date constitutes acceptance of the updated Terms.
These paid-search and trademark restrictions apply to advertising activity occurring on or after September 28, 2026. They are not intended to retroactively alter commissions earned before that date.
